Changes to Bankruptcy and Insolvency Legislation for Public Post-Secondary Institutions – Now What?

Bill 59 amends both the Bankruptcy and Insolvency Act (“BIA”) and the Companies’ Creditors Arrangement Act (“CCAA”) to exclude “prescribed public post-secondary institutions” from the definition of “corporation” (BIA) and “company” (CCAA).  The amendment to the CCAA has been touted as a “win” by some.  It has also been depicted as a form of protection against university financial crisis.  This webinar will clarify the implications of Bill 59 for universities and provide universities with an overview of what legal remedies are available in the event of a university financial crisis, given the amendments to the CCAA and BIA.
